To access the paid service, you must create an account by providing your name, email, and password. You agree to:

• Provide accurate and up-to-date information.
• Keep your password confidential.
• Notify us of any unauthorized use of your account.
• Not create more than one account per person.

FluentUp reserves the right to suspend or cancel accounts that violate these terms.

FluentUp offers three subscription plans (Starter, Plus, Pro) with monthly or annual billing. Prices are displayed on the pricing page and include VAT where applicable.

• Payments are processed through Stripe. We do not have access to your card details.
• Subscriptions renew automatically at the end of each billing period.
• You can cancel your subscription at any time through the Stripe management portal. Cancellation takes effect at the end of the current paid period.
• No refunds are provided for unused partial periods, unless required by applicable law.
• Each plan includes a monthly practice hour limit. Unused hours do not carry over to the next period.

By using FluentUp, you agree not to:

• Use the service for illegal or unauthorized purposes.
• Attempt to access other users' accounts or internal systems.
• Interfere with the operation of the service or its infrastructure.
• Use automated tools (bots, scripts) to interact with the service.
• Share your account with third parties or resell access to the service.
• Use offensive, threatening, or discriminatory language during practice sessions.

FluentUp uses artificial intelligence (language models and voice synthesis) to generate conversations and feedback. Please be aware that:

• AI coach responses are automatically generated and may contain errors or inaccuracies.
• CEFR scores and feedback are indicative and do not constitute an official language certification.
• FluentUp is not a substitute for a professional language assessment or a formal educational program.
• Grammar corrections and vocabulary suggestions are AI-generated and should be taken as guidance, not as absolute reference.

All FluentUp content (design, code, 3D avatars, text, logos) is owned by Gonzalo Hafner Roda or its licensors and is protected by intellectual property laws.

Your content (session transcripts, progress data) belongs to you. You grant us a limited license to process and store that content solely for the purpose of providing the service.

FluentUp strives to keep the service available 24 hours a day, 7 days a week. However:

• The service may be interrupted for maintenance, updates, or force majeure.
• We depend on external providers (ElevenLabs, AWS, Stripe) whose availability is outside our control.
• We do not guarantee 100% availability and will not be liable for damages arising from service interruptions.

To the extent permitted by law:

• FluentUp is provided “as is”, without warranties of any kind, express or implied.
• We are not liable for indirect, incidental, or consequential damages arising from the use of the service.
• Our total liability in any case is limited to the amount paid by the user in the 12 months preceding the event giving rise to the claim.

These limitations do not affect your statutory consumer rights under applicable law.
